All Political Power is Inherent in the People

On November 30, 1996, a Convention of Delegates of the 30 Land Districts of the Republic of Texas convened in College Station, Republic of Texas at the Ramada Inn on Texas Avenue. The convention was called and convened due to a crisis of the Provisional Government. It became apparent to the People that the problems that existed within the General Council could not be solved by the Council and it fell to the People to resolve the situation. Let's take a moment to look at what was happening leading up to the Convention.

On October 18, 1996 a secret meeting was held at the home of Archie Lowe, who was the President of the Provisional Government at that time. The meeting was orchestrated by Richard McLaren who was the Chief Ambassador and Consul General. The purpose of the meeting was to have a document created and signed to create a trust called the "Republic of Texas Trust." There were many problems with this, in substance as well as procedure. In terms of procedure, the People had already expressed that there were to be no secret meetings wherein business of the Republic of Texas was consummated. Anything that needs to be done in secret that affects the People is automatically suspect and is usually wrong. It furthers the wrong when the actions and substance of the meeting are not made public so that the People know what is being done that affects them. It was finally disclosed about 4 weeks later, and under great pressure from the People, that anyone who had a copy of the trust would be fined one million dollars if they disclosed any of the contents of the trust to anyone. Does this sound secret to you?

In terms of substance, we must understand that the Republic of Texas is committed to being subject only to the common law. We also must understand that artificial entities of any kind are repugnant to the common law. Common law is based upon personal responsibility. Any artificial entity, whether it be a trust or a corporation, is designed exclusively to protect assets from the liability of the parties involved and limit their personal responsibility for their actions. Under de facto statutory law, trusts are appropriate to protect from the unlawful seizure that goes on every day, but this protection is not necessary under the common law. So why did McLaren find it necessary to put the Republic of Texas into a Trust? The author of this article called him to ask that very question in addition to the question: "Why are we creating a trust for the Republic when artificial entities are not compatible with the common law?" There was no answer forthcoming from McLaren to explain the action of creating this trust. The only thing he could say was, "Well, we've just got to do it!!" There was no explanation as to why we had to do it or how this trust could be squared with the common law.

Another point that is extremely important for the reader to understand is that the very reason for the formation of a Provisional Government was to restore a lawful, de jure government. A de jure government is one made up of real men, living beings with souls, who are responsible and accountable to the people for their actions. By putting the Republic into a trust, it literally overthrew the elected Provisional Government and created an artificial entity to govern and control. This artificial entity, if valid, would own all the land in Texas. It would eliminate any private ownership of land in this nation. From the beginning, McLaren has used and, more importantly, misused the application of "Eminent Domain." Eminent Domain is a principle that violates the substantive rights of the People to hold absolute ownership of property. It gives the government the power to take private property for public use. In most constitutions that espouse this principle the government is also charged to pay "just compensation" to anyone whose property is taken. We hold that the taking of anyone's property, without due process of the common law or consent of the owner, is unlawful and outright theft, and that the principle of eminent domain cannot stand valid in true common law, and in a nation of truly free people.

In almost every document McLaren ever prepared, he uses the argument of "eminent domain." And he uses it incorrectly. There was a lien filed called the "Eminent Domain Lien" and a certificate filed with every country in the world certifying the Eminent Domain Claim. In effect, this one man, Richard McLaren, was claiming to own ALL the land in Texas. And, unlike the principle as espoused in the constitution, he never offered anyone any compensation, just or otherwise! This is the very same tactic that the United States used early on to be able to operate outside the constitution and do away with the substantive rights of the People. It has been said that the ownership of all property purchased with Federal Reserve Notes is held in trust by the U.S. Government (or some other commercial entity).

McLaren was attempting to perpetrate the same fraud upon the people of Texas. The only difference is that he told the People that this was to guarantee their freedom![?] The purpose, in fact, was to guarantee control of a few over the many, and be able to monetize the land of Texas to enrich the few. If this trust had not been stopped, McLaren would have been able to sell Texas to the highest bidder in the international market. It had to be stopped!!!

Back to the Articles of Inception that was created and signed that day in October, another fraud was being fed to the People. McLaren had magically created a three-branch government out of the Provisional Government which was not given three branches of government by the people. He argued that since the Provisional Government had recognized the common law court in Tarrant County as the first common law court to operate on the soil of Texas since 1845, that it was a government court and was the "judicial branch" of government. The only problem with this argument is that this court was created by the people, for the people and was and still is totally separate and distinct from the government. It is not, and never has been , a government court. There is no judicial branch of the Provisional Government!!

The reason this argument was put forth was to attempt to give a lawful appearance to the signing of the Articles of Inception of the trust. In McLaren's view, the executive branch, consisting of a President and Vice President and the Judicial Branch, consisting of the judge of the common law court, was two out of three of the branches of the Provisional Government. The third was the rest of the General Council acting as the legislature. McLaren argued that, since the document was signed by representatives of two of the branches, it was valid. The signatories were Steven Crear, Vice President and Timothy Perkins, judge of the common law court. This entire argument was totally bogus, as the intent of the People always had been very clear that any action done that affected the People must have the approval of the General Council. Most of the Council members were never informed of the creation of this trust, and none but those present at the meeting knew of the meeting being conducted.

The Articles of Inception of the trust was effectively voided by the People of the common law court who, when the judge was elected, specifically reserved the right to remove his signature from any document he signed outside the presence of the common law jury if it were determined to be incorrect or unlawful. The only signature authority he had been given, in fact, was for those processes necessary for the operation of the court. Creating a trust to put the Republic of Texas into is not necessary for the operation of the court. The People voted unanimously to remove his signature from the document. The Republic of Texas Trust does not exist! There were many other problems on the Council during this time, but the creation of the trust, and the placing of all of Texas into the trust was the paramount concern. This action, if valid, would have completely taken the authority of the Provisional Government out of their hands and placed it into the hands of un-elected people chosen by McLaren. This is clearly and unequivocally an attempt to overthrow the elected government by the very man who was instrumental in getting the people to create the elected government.

There were seven members of the Council who were kept totally in the dark about all these actions and who, when they became knowledgeable of them, stood with the People in absolute opposition. That made the Council split with seven on each side of the argument and one who oscillated back and forth. Since all actions of the council require at least a majority, and most actions require a two thirds majority, the Council was at a stalemate and could do absolutely nothing. This left McLaren free to continue with his personal takeover, as there were not enough council members who understood the truth to stop him. On November 15th and 16th a meeting of the General Council was held in Odessa. On Friday the 15th, a common law court was convened for McLaren's purpose of attempting to remove all the opposing members of the council from their positions. This action was stopped by the people. On the 16th, at the regular Council Meeting, the People stood and confronted McLaren, Lowe and other council members about the trust.

The People were insulted, ridiculed and told that the trust was none of their business and McLaren stated: "You people are stupid, and I don't need you. I'll form my own coalition government." The People were informed by a former McLaren supporter of the situation where, at McLarens leading, a meeting had occurred at the McLaren "Embassy" in Fort Davis in the middle of the night. At this meeting somewhere in the neighborhood of two and a half billion dollars of "treasury warrants" had been produced on the computers there. These so-called treasury warrants were to be backed by all the people of Texas!!!! This is the exact same thing the U.S. government has done to make the American people liable for the national debt!! We weren't interested and knew that McLaren and his supporters had to be stopped.

When that meeting concluded, it was announced that there would be a Convention of Delegates on November 30, 1996. On November 23, 1996 a citizens grand jury was called to investigate the matter. Evidence was presented regarding the actions of McLaren, Archie Lowe , Steven Crear, and Timothy Perkins in perpetrating this fraud upon the people. The purpose of the grand jury was simply to have a formal Statement of Facts regarding this entire matter, that could be presented to the People at the Delegates Convention. However, even though indictments were not asked for, the grand jury made the decision to issue indictments against all four men. Since then there has been one trial. Archie Lowe stands convicted of Treason by the common law court. The following weekend, November 30, the Delegates Convention was held. The agenda included the consideration of revising the Plans and Powers of December 13, 1995 and to consider the removal of members of the General Council.

The Convention was called to order and roll was called to determine how many land districts were represented. The People knew that it was necessary to have a quorum (majority) in order to conduct business. At first count, the secretary of the convention announced that there were delegates from 15 of the 30 land districts. Two of the delegates had also been keeping track as the role of districts was called and said they had counted 17. An audit was conducted and there were, in fact, 17 districts represented . Before beginning conducting the business on the agenda, however, representatives from the 18th district arrived. There was clearly a majority of districts represented, which constituted a lawful quorum. Those that argue that this was an "unlawful citizens meeting" contend that there was not a quorum. Their argument is based on one person's video tape of the meeting. This person, in an effort to save tape, had stopped taping when the audit was being conducted and by the time he re-started his video recorder the announcement that 18 districts were present had already been made. That is why anyone having only the tape as evidence would be mislead to the incorrect conclusion that there was not a quorum. There are approximately 300 witnesses to the truth that there was, in fact, a lawful quorum, and it's beyond reason to suspect that all 300 would falsely attest to this fact.

What happened at the convention? The first order of business was to revise the Plans and Powers of December 13, 1995. Following are some of the revisions made by the delegates: The position of Secretary of State was eliminated as an elected position thereby removing Robert Kesterson from the General Council. It is now an appointed, non-voting position. The record keeping duties of the Secretary of State were transferred to the Secretary of the Council. The Secretary of the Council was eliminated as an elected position. It is now an appointed, non-voting position. The position of Chief Ambassador and Consul General was eliminated and the responsibility for all ambassadors and foreign service officers and matters was transferred to the Secretary of State. The position of Consul General as Chief Foreign Legal Officer was created and remains in the Plans and Powers. The position of Secretary of Interagency Coordination was eliminated, thereby removing Carolyn Carney from the General Council and all duties of this office transferred to the Secretary of the Council. The position of Secretary of Defense was eliminated, thereby removing Dr. Ralph Turner from the General Council. The duties regarding Sheriffs, Constables and Police were transferred to the position of Counsel General. The duties regarding the Texas Defense Forces were transferred to a newly created appointed position of Commander of the Texas Defense Forces.

Archie Huel Lowe, Steven Craig Crear, Richard Lance McLaren and Ray Wanjura were removed from their offices by a majority vote of the Delegates in Convention. The following people were elected by the Delegates in Convention to fill vacancies created by the actions of the Delegates:

The following positions were filled by appointment and approved by the General Council:

Daniel Coheleth Lopez, Secretary of State
Linda S. Roberts, Secretary of the Council
Sam Nauman, Commander of the Texas Defense Forces

The following council members, previously appointed by actions of the General Council, were affirmed by election by the Delegates in Convention:

Ed Brannum, Secretary of Privatization
Jeffrey Stuart Katz, Secretary of Science and Technologies
D.A. West, Secretary of Agriculture and Environment

This Convention of Delegates re-formed the Provisional Government and removed those who were acting outside their delegated authority, violating the common law, and violating the rights of the People of Texas either knowingly or unknowingly. That statement is made because, in the authors opinion, a few of the men involved thought they were doing the right thing, but were simply duped by McLaren and did not understand the true nature of his actions. This is evidenced by the fact that Archie Lowe's group, a few months later, also removed McLaren when they came to understand.

The most unfortunate fallout of this action by the People, is that it was rejected by McLaren and his followers as an "unlawful citizens' meeting." It doesn't take much thinking by anyone who understands freedom in the slightest degree, that there cannot be such a thing as an unlawful citizens' meeting. If they were going to argue something, it would have to be that there wasn't a quorum, so the actions were unlawful. Of course this is not the case, since there was in fact a quorum as already stated.

At all the General Council meetings the statement is usually made by someone that "All political power is inherent in the People." This is the principle upon which the Provisional Government was initially formed and is the principle upon which we, the People of the Republic, operate today. It was truly a tragedy in the Republic when the elected officers who were removed by the People failed to recognize the actions of the People. That is the single factor that has led to the factions or groups of people in the Republic. But, hasn't it always been so? Those who have power, or think they have it, want to hold on to it at all costs, forgetting the source from which they derive any power. That source is the People.

Another point that the author thinks that it is extremely important to note is regarding McLaren and the law. He authored the original documents wherein the People stated that Texas was returning to the common law. He brought numerous cases to the Peoples' Court of Common Law. He was a vocal advocate of the common law. However, when the people came together under common law to take action against him, he refused to respond and didn't show. He said, "The court is breached and I suspend it."ONE MAN suspending the acts of the people? I don't think so. Then he was tried in the State of Texas courts for crimes against his neighbors, namely kidnapping. He screamed throughout the trial, "this court has no jurisdiction!!" The question is simple. If McLaren is not subject to common law, and is not subject to statutory law, what is the law to which he is subject? The answer is "NONE." He makes his own law as he goes, to suit his own purpose. One of the most telling statements he ever made was in on a radio talk show scheduled as a debate with Jesse Enloe. He stated that he was operating "under the authority delegated to me by International Law." Think about this statement. Does the LAW delegate authority to anyone? Only people have the inherent ability to DELEGATE something, and they can only delegate that which they possess. A man without a law to which he subscribes is a lawless man. The results of "McLaren's Law" are obvious for the world to see.

Unfortunately, this was not the last Delegates Convention for the purpose of removal of a wayward officer of the General Council. On August 23, 1997 it was necessary for the delegates once again to assemble. The purpose of this convention, called by a supporter of the [then] President, David Johnson, was to remove all the other members of the General Council and replace them with Johnson supporters. But the truth of Johnson's agenda to have a theocracy with him and his father as the dictators was exposed and it was Johnson who was removed from office.

The People of the Republic remain dedicated and strong, striving for their goal of Freedom. Freedom for ALL the People of Texas. To be loosed from the yoke of the oppressor. That is their cry. As of the date of this writing, the following are the true, lawful, elected members of the General Council, the Provisional Government of the Republic of Texas:

This group of men are dedicated to the restoration of freedom to the People of Texas, no matter what the personal cost. That is their only agenda, their only purpose. We believe that our Almighty Creator is the author of this movement to reclaim Texas as an Independent Nation in order to restore the freedom of the People. It is to this cause that they, and all the declared Citizens of the Republic of Texas, have dedicated their lives, their fortunes, and their sacred honor.
