I was listening to KTSA on 01-11-99 at approximately 7:45 AM, when you stated that the STATE of TEXAS only collected two taxes at this time. Those being a Retail tax and a Property Tax. I would like to know if you were talking about Ad Valorem property taxes; for if you were, the STATE of TEXAS is violating U.S. FEDERAL LAWS forbidding any of the STATES acting as CORPORATE ENTITIES to collect or aid in the collection of ad valorem taxes. I Am enclosing an EXHIBIT "A," wherein the acting legislature voted to abolish the collection of ad valorem taxes.
Also, one of the KTSA talk show hosts asked you if the Lottery money went into the General Fund. Your answer was that all Lottery income went to Education as of the 1997 legislation acts. Well Sir, I would like to call your attention to the (CAFR) Comprehensive Annual Financial Report or the STATE of TEXAS CORPORATE 2nd set of books, wherein it defines General Revenue as, "to add unobligated funds" and then, in defining the Lottery, it reads to "place unobligated funds into the General Fund."
Then, I would like to refer you to the 3RD SET OF BOOKS, the 1998 (ACR) Annual Cash Report kept by THE STATE COMPTROLLERS office. On page 611: Lottery Fund Account #5025 Revenue # 3922 "Transfers from Lottery Account Fund #0001 (GENERAL FUND) to Unobligated General Revenue Fund or Texas Lottery COMM. OPER. ACCOUNT." $ 232,751,132.92 Million. Then go to page 612-Expenditures, code 7922 "Transfer from Lottery Account Fund 0001 to Unobligated General Revenue or Texas Lottery COMM.OPERATING ACCOUNT." $1,389,445,812.92 BILLION. As you will also notice, on this same page there is a PETTY CASH ACCOUNT we all would love to have to play with, "$4,025,000 Million."
My challenge to you is telling the citizens of Texas, a Republic, the TRUTH and if you, Sir, can find anywhere this money leaves this Trust Fund and is used for Education, please fax me as to where to look or who can tell me the TRUTH. Now I would like to refer you to an additional Trust Fund on Page 510 called LOTTO PRIZE TRUST FUND / NET CASH BALANCE Aug. 31st 1998 / $1,140,884,119.34 BILLION. Again, nowhere is Education mentioned for any of these Funds.
It appears, after researching the OFF-BUDGET BOOKS and CORPORATE PROFITS OF THE STATE OF TEXAS in books that the average CITIZENS never see or hear about, the STATE OF TEXAS has in its coffers a MINIMUM of $1,500,000,000,000 TRILLION. These Funds could free ALL Texans from all Taxation for the next 30 years. I am sending you EXHIBIT "B," "What is a Comprehensive Annual Financial Report?," which includes information on how to acquire a copy. You may also get the Annual Cash Report from the same source. These are public documents.
