Are They Constitutional? Where Did They Come From?
When Did They Start? What Do They Do?

 Many People have been noticing that there seem to be many actions taken by the government these days that do not go along with the Constitution. In other words, actions are taken by government agencies that seem to be outside the Constitution or in direct violation of it.What we must learn is that Administrative Agencies of the government ARE outside the Constitution and they are not bound by it.

 How did this happen and when did it start? This is the question we will answer here.

 In 1933, when Franklin D. Roosevelt became President, the country had been in the great depression and it was in bankruptcy. He had to create a way to administer the bankruptcy, to keep the International Bankers from foreclosing.

 He told the Congress, when he took office, that he wanted great powers, as those provided to the President in times of war (War Powers). He formed Administrative Agencies that operate outside the law set forth in the Constitution, to unlawfully regulate every area of American life. If you doubt this read on to see the proof!

The following is quoted from the first page of House Report No. 1980, May 3, 1946 --- THE LEGISLATIVE HISTORY OF THE ADMINISTRATIVE PROCEDURES ACT

 "For more than 10 years this legislation has been under consideration. Certainly no measure of like character has had the painstaking and detailed study and drafting. Both the legislative and executive branches have participated, and private interests of every kind have had an opportunity to present their views. In the legislative branch there have been four major proposals for the creation of an administrative court, and at least eight for the regulation of administrative procedure. Two important studies were conducted in the executive branch under the late President Franklin D. Roosevelt -- each resulting in reports to Congress with legislative recommendations...

1937 Report of President's Committee on Administrative Management . The growth and intensification of administrative regulation ofprivate enterprise and other phases of American life had moved President Roosevelt early in his administration to appoint a committee to study administrative methods, functioning, and organization. Although that committee approached the problem from the standpoint of executive branch management, it was soon deeply involved in the essential public processes of administrative regulation. It issued numerous studies and an extensive report (Report With Special Studies, 1937), which President Roosevelt transmitted to Congress with his endorsement and the statement that it was "a great document of permanent importance " (p. iii) At that time he also took occasion to remark that the practice of creating administrative agencies -- who perform administrative work in addition to judicial work, threatens to develop a fourth branch of the Government for which there is no sanction in the Constitution."

To which the committee added (p. 40):

"There is a conflict of principle involved in their make-up and functions. * They are vested with duties of administration * and at the same time they are given important judicial work. The evils resulting from this confusion of principles are insidious and far reaching .* Pressures and influences properly enough directed toward officers responsible for formulating and administering policy constitute an unwholesome atmosphere in which to adjudicate private rights. But the mixed duties of the commissions render escape from these subversive influences impossible. Furthermore, the same men are obliged to serve both as prosecutors and judges."

It is clear from this report that everyone in the government, from the President on down, knew that they were creating agencies that would operate of behalf of the government while being entirely outside the Constitution. It is also clear that Administrative Agencies clearly violate the separation of powers principle of the Constitution as they engage in Executive, Legislative and Judicial functions as they operate to administer their regulations.

All courts are now administrative courts and are not courts of law as we perceive them to be. They operate on administrative law and procedures.

 The list of Administrative Agencies is almost endless. There's the EPA, IRS, FBI, CIA, BATF, OSHA, HUD, DOD just to name a few. Almost the entire government now operates as Administrative Agencies.

These agencies promulgate regulations which become the "law of the land" as far as they are concerned. These regulations are imposed on all the People of the land as if they actually were the "subjects" of these agencies.

 Where in the Constitution did the People of the land delegate the authority to the government to "subjugate" them in any manner whatsoever? If you read the Constitution you will find that the People wrote it to set forth the LAW that the government was to operate by.

We think of the government as the only law enforcement power but it is the People that must hold the government to obey the law.

Over the last hundred years or so, we have slowly lost our freedom to "government regulation". The only way to stem the tide of having every area of our lives regulated by "government" is for the People to awaken and demand that the government obey the law. The law that is set forth for them in the Constitution.

 Sadly, however, it appears that the government is so corrupt in its thirst for power to regulate the People that it may be too late to repair the one we have.

Regardless of this, the only answer to the plight of the People, is for them to open their eyes and see the government for what it is. To look at what it is supposed to be and compare that with what is really going on. Only then will we be able to see the real truth and have the Political Power of the People focused to solve the problem.

This country must have a government that obeys the law. We must realize that the People are the ones who set forth the law for the government. After all, they serve us, right? If so, we must insist that the government do the main job it was formed by the People to do, and that is to PROTECT THE LIBERTIES OF THE PEOPLE, not to plunder their rights and their property!!
